The Workplace Relations Commission directed Fionnuala Fallon T/A Park Pets Veterinary Clinic to pay Molly Sidiakina €5,306.88 net after finding her complaint over notice pay well founded. The decision was dated 13 November 2023.
Sidiakina worked at the clinic from April to August 2022 and received one week’s pay when her employment ended. She said she was entitled to 12 weeks’ notice under the employment terms and what Fallon had told her; Fallon paid statutory notice of one week.
The written terms were inconsistent: the handbook set out one week during probation, while a later statement included a 12-week notice clause but omitted the probation text it referred to. The adjudicator accepted that Fallon had discussed 12 weeks’ notice with Sidiakina, including the day before her dismissal. Six weeks’ net pay was considered reasonable in the circumstances, and the award was equivalent to that amount.
