The Workplace Relations Commission awarded Bruno Batista €1,500 after finding that Dc Farm Machinery Ltd unfairly dismissed him. In a decision dated 2 May 2024, the WRC also awarded him €1,060 for three linked complaints over late employment information.
The company said it dismissed Batista over concerns about his work. The adjudication officer found that the dismissal process failed to meet fairness requirements, despite the alleged performance issues. The officer also found that Batista contributed significantly to his dismissal and took that into account when setting compensation.
The WRC found the company had not provided required employment information within the legal timeframe. Batista's race discrimination complaint failed because he had not established facts from which discrimination could be inferred. He had withdrawn the discriminatory-dismissal part of that complaint.
