WRC disallows chef’s redundancy appeal

The Workplace Relations Commission disallowed Tomasz Jarosz’s appeal for a statutory redundancy payment from Edenlough Limited. The decision was dated 18 December 2023. Jarosz had worked as a chef for the company from September 2006 until November 2022. Jarosz said he had been dismissed by reason of redundancy and believed he was due €20,316. The company said it had offered him an equivalent role on equivalent terms, which he refused. The adjudication officer found the September 2022 letter did not expressly end his employment and concluded that no dismissal took place: Jarosz chose to leave and seek work elsewhere. The WRC therefore disallowed his appeal.
