The Workplace Relations Commission had no jurisdiction to hear John Nolan’s annual leave complaint and found his force majeure leave complaint not well founded. The decision was dated 18 December 2023. Nolan, employed by Kilkenny County Council since 2000, challenged the withdrawal of leave granted so he could take his son to a scheduled hospital appointment. The WRC said the advance notice meant there was no urgent family reason requiring his immediate presence. It also said the council was entitled to withdraw approval after receiving further information. The merits of the annual leave complaint were not decided: the WRC said the earlier leave year was outside the time limit and the next leave year was still under way when he complained.
