The Workplace Relations Commission upheld Rodica Buga’s redundancy claim against Bidvest Noonan (Roi) Limited, directing the company to pay her a redundancy lump sum based on her service from 6 January 2003 to 31 August 2022 and gross weekly pay of €500. Buga had worked as a cleaning operative. After the premises where she worked closed for renovations, the company offered her a role at State Street and said she could try it for a week. She argued that the work involved disinfection duties she could not safely perform and would require her to walk to public street parking at 2am. The adjudicator found that Buga was reasonable to refuse the role because of the additional duties and lack of secure parking. The company had not defeated her entitlement to redundancy pay. The WRC also found her separate minimum-notice complaint was not well founded, as she received and worked eight weeks’ notice. The decision was dated 6 February 2024.
