The Workplace Relations Commission disallowed Seamus Stapleton’s appeal for a redundancy payment, finding that he resigned from O'Brien Facilities Limited rather than being dismissed. The decision was dated 30 August 2023. Stapleton said he was told there was no further work for him and claimed he was due redundancy pay. The company said he declined temporary work in Dublin and chose to resign under a contract that allowed work at different locations. A co-worker’s evidence supported the company’s account that Stapleton said, “I resign.” The adjudicator found that Stapleton had resigned and noted that the company offered his job back several times, which he declined. A redundancy payment is generally due when an employee is dismissed for redundancy; the WRC therefore disallowed his appeal under the Redundancy Payments Acts.
