The WRC found Ballyvolane Pharmacy Limited breached employment terms rules by failing to provide a signed and dated contract for Aderana Dunne. It ordered four weeks’ remuneration based on a 28-hour week as compensation. The decision was dated 23 August 2023. Dunne, a pharmacy technician, said she resigned in March 2022 after workplace concerns and a proposed return in a customer service role. The WRC found that constructive dismissal was not established, noting that she had not pursued her concerns through the grievance process. The officer also found the Payment of Wages complaint not well founded. Dunne said her contract listed €13.75 an hour while she was paid €13.70; the employer said the higher figure was an administrative error. The WRC found she had not established that the higher rate was properly payable.
