The Workplace Relations Commission found Patricia Whelan’s complaint about public holiday pay not well founded. The decision was dated 7 March 2023. Whelan challenged how pay was calculated for her rotating 12-hour shifts, including shifts that crossed into or out of a public holiday and days when she was not rostered to work. Bausch Health Ireland Limited Bausch And Lomb said its method met the statutory rules. The adjudicator found overtime was properly excluded from the calculation for a paid day off and that payments for shifts overlapping a holiday exceeded the additional day’s pay required by law.
