The WRC rejected a care worker’s complaints about changed work terms and constructive dismissal, although it found she had made a protected disclosure. Adjudication Officer Seamus Clinton dated the decision 11 March 2024.
The worker said she was told not to attend two shifts and resigned on 9 September 2022, believing the treatment followed her disclosure to an outside agency. The care provider said it was unaware of the disclosure during her employment, had concerns for her welfare and offered support and meetings.
The officer found the Terms of Employment complaint was not well founded because the worker was notified the day before not to attend the shifts. He found the provider did not breach her contract or act unreasonably, and that she had not raised a formal grievance or taken up offered meetings. He also found no evidence of adverse treatment or a link between the disclosure and her resignation. The WRC found she was not unfairly dismissed.
