The Workplace Relations Commission found that Jennifer O’Connor could not bring a complaint under fixed-term work legislation because she was not a fixed-term employee within the Act’s definition. The decision, dated 11 March 2024, rejected her complaint against An Garda Síochána.
O’Connor had worked as a cleaner since 2016, without incremental pay credit, paid sick leave or a written contract. An Garda Síochána gave her a contract of indefinite duration in June 2023, backdated to April 2019, with improved terms. The law covers employees whose contracts end on an objective condition, such as a specified date or event; the WRC found the evidence did not establish that kind of contract.
