The Workplace Relations Commission found Karina Marchwinska’s Payment of Wages complaint against Sherlock Recruitment Limited not well founded in a decision dated 5 April 2023. Marchwinska worked as a recruitment consultant from January to April 2022 on a salary of €27,000, with guaranteed commission of €3,000 pro rata for her first three months. She claimed commission for three permanent placements made before she left. The company said commission on permanent placements became payable when the client paid, and it had not received payment before she left. The adjudicator accepted that evidence and found there was no evidence the commission was properly payable or that a deduction had been made from her wages.
WRC finds no deduction in recruitment consultant’s pay complaint
