WRC declines jurisdiction over two employment terms complaints

The Workplace Relations Commission declined to hear two complaints by Mairead Hanlon against Ard Churam Day Care Centre over her employment terms. The decision was dated 22 January 2024. Hanlon said the employer changed her terms by requiring her to work at its day care centre without notifying her as required. The WRC refused to extend the time limit for that complaint, finding that her reasons did not explain and excuse the delay; it therefore had no jurisdiction to decide the claim. Her second complaint alleged that her statement of core terms deliberately contained false or misleading information. The WRC said the allegation concerned an offence outside the adjudication service’s remit, so it had no jurisdiction to hear it. The merits of either complaint were not decided.
