The Workplace Relations Commission has found two complaints by Ann Maria Desmond against the Health Service Executive not well founded. In a decision dated 11 August 2023, it rejected claims of discrimination and equal pay.
Desmond said she was overlooked for regularisation after returning from maternity leave and sought the grade of higher-graded colleagues. The HSE argued that an agreement settled the grading issue. The adjudication officer found Desmond had authorised her union official to confirm her consent to the agreement and was bound by it. The officer also found no evidence to support her allegation of a discriminatory contractual provision.
