The Workplace Relations Commission has found Daniel Hughes was not constructively dismissed by Action Alarm Control 24 Limited. In a decision dated 11 August 2023, it found his two penalisation complaints were out of time and his dismissal complaint was not well founded.
Hughes said he was penalised after isolating as a close contact during the Covid-19 pandemic, including through disciplinary action and being passed over for an acting supervisor role. He said he resigned because he felt unsafe. The company said it followed HSE guidance and had measures to provide a safe workplace. The adjudication officer found Hughes had not shown that the company’s conduct left him no option but to resign. The WRC said the penalisation claims were out of time, meaning it could not investigate them; the merits were not decided.
