The Workplace Relations Commission found all seven complaints brought by former Ballyfin Demesne Limited food and beverage assistant Jack Cuddy not well-founded, including his claim that he was constructively dismissed. The decision was dated 1 December 2023. Cuddy said the hotel failed to notify him in writing of changes to his employment terms and that its conduct led him to resign. He also alleged discrimination, harassment, victimisation, health and safety penalisation and less favourable treatment as a part-time worker. The hotel denied the complaints. The adjudication officer found no change to Cuddy’s written terms and said he had not shown that the hotel’s conduct justified his resignation. The officer also found no discrimination, victimisation or penalisation. His equal-pay complaint failed after his hourly rate was brought into line with his comparator’s.
