The Workplace Relations Commission directed Mht Lighting Ltd. to pay Geraldine Hamill €3,835 compensation after finding the company failed to provide a statement of employment particulars. The decision, dated 3 February 2023, also upheld five other complaints, including claims over wage deductions and annual leave.
Hamill said the company had made unlawful deductions and failed to provide statutory entitlements. The company argued she was a self-employed consultant and that some deductions reflected days she did not work. The WRC found she was an employee, relying particularly on a letter describing her full-time director role as integrated into the company’s management structure. It directed the company to pay €3,278 for one wage-deduction complaint, €1,092 for another and €3,500 compensation for the annual-leave breach. Two further complaints were upheld: one concerning public holidays and one about the five-day employment statement requirement. The WRC made no compensation award on either of those two complaints.
