The Workplace Relations Commission found three complaints by ESB Networks technician Shane Flynn not well founded in a decision dated 13 December 2022. Flynn argued that introducing the MyTime timesheet app changed his employment terms and that delayed overtime and allowance payments penalised him for refusing to use it. ESB Networks said MyTime replaced an obsolete timesheet scanning system and that payments outside basic wages were delayed for staff who continued using paper timesheets. The WRC found the app changed work practices, not Flynn’s employment terms, and that the payment delay was not an unlawful deduction. It also found no link between the delay and his union membership; the delay arose from his refusal to use MyTime. Flynn was due €4,567.25 on 17 June 2022, but the WRC found the delay did not make the payment unlawful.
