The Workplace Relations Commission found that Laura O’Connor was not a fixed-term employee under the law and could not maintain her complaint against An Garda Síochána. The decision was dated 11 March 2024.
O’Connor worked as a cleaner from 2016, initially covering for absent staff and later working full-time at different locations. She lacked incremental pay credit, paid sick leave and other leave benefits available to permanent cleaners before receiving a contract of indefinite duration in June 2023, backdated to April 2019. The Act applies to contracts ending on an objective condition, such as a set date or event; the WRC found the evidence did not show that kind of employment arrangement.
