The Workplace Relations Commission awarded Aurel Iulian Nechita €597 net compensation after finding his wages complaint against Keegan Quarries Ltd well founded. The decision was dated 11 April 2023.
Nechita said the company had not paid him for all the hours he worked and had withheld holiday pay when his employment ended. The respondent did not attend the hearing. The WRC proceeded on Nechita’s evidence and found that payable wages had been withheld without his agreement or a contractual basis, contrary to the Payment of Wages Act.
The WRC calculated that Nechita worked 157 hours over three weeks and accrued 12.56 hours of holiday pay. It found gross wages due were €2,339.93, compared with €1,592.80 paid, leaving a gross shortfall of €747. The WRC estimated the net amount at €597 and directed payment of that sum as compensation. It said it could not award payment for unpaid travel and subsistence.
