The Workplace Relations Commission found it had no jurisdiction to hear Britney Sugar’s complaints against Supervalu because they were referred outside the time limit; the merits were not decided. The decision was dated 11 April 2023. Sugar worked as a sales assistant for just over two months in 2020. She said alleged harassment and bullying contributed to her resignation. She referred her complaints about working time and written employment terms to the WRC more than 10 months after her employment ended. Sugar said she had struggled to find a solicitor, did not know she could complain to the WRC and was affected by COVID-19 restrictions. The adjudication officer found those reasons did not explain and excuse the delay, and that reasonable cause to extend the deadline had not been established.
