The Workplace Relations Commission found Mahon Finlay’s complaint against the Revenue Commissioners Corporate Services Division was not well founded. The decision, dated 5 January 2023, concerned a salary adjustment and deduction that Revenue said reimbursed an overpayment. Finlay argued that his enforcement allowance and Customs shift allowance were different, so the adjustment should not have been made. The WRC found both allowances were flexibility payments for work outside standard office hours and were the same type of payment. It concluded the amount treated as overpaid was not properly payable to him, so the deduction was not unlawful.
