The Workplace Relations Commission awarded Sarah Carthy €2,040 after finding that her employer failed to provide a written statement of her employment terms. The decision, dated 15 September 2023, also awarded her €1,020 for failing to notify her in writing of changes to her terms and a further €2,040 over missing written core terms.
Carthy began work as a deli manager in November 2021, earning €15 an hour. The employer said the café closed in December and that her employment ended then. The adjudicator accepted Carthy’s evidence that she remained employed when the business reopened in January 2022, and found that the employer had not shown it took steps to provide the required written terms.
The three complaints under the Terms of Employment (Information) Act were upheld. The complaint under the Payment of Wages Act was withdrawn at the hearing.
