The Workplace Relations Commission found that Geraldine Noonan was not an employee of the Department Of Education and rejected her complaint seeking a written statement of employment terms. The decision was dated 28 May 2024.
Noonan said she had worked as a home tutor since 2006 and that the Department set her hours and workplace. The Department argued that parents engaged tutors privately and it handled grant payments only as a payroll agent.
The adjudication officer found that parents hired tutors under private arrangements and that the grant did not create an employment contract between Noonan and the Department. The complaint was found not well founded.
