WRC says Killarney Brewing complaints were outside time limit

The WRC found Brian O'Leary’s complaints against Killarney Brewing Company Limited were brought outside the time limit and were not well founded; the merits were not decided. The decision was dated 16 January 2023. O'Leary said he was forced to resign after difficulties with management, including a bonus issue, and claimed unpaid annual leave and a bonus. The company said he resigned voluntarily and that all payments due had been made. The adjudication officer found the employment relationship ended on 21 June 2021 after the handover, and the complaint was received on 23 December 2021. The officer said there was no jurisdiction to decide the claims because they were outside the statutory time limit. O'Leary did not seek an extension.
