The Workplace Relations Commission found three complaints by Network Technician Gerard Tuohy against ESB Networks not well founded. The decision, dated 13 December 2022, concerned the company’s MyTime timesheet system and delays to overtime and allowance payments. Tuohy argued that introducing MyTime changed his employment terms and that delayed payments were linked to his Independent Workers Union membership. ESB Networks said the app replaced paper timesheets to support payroll processing, and that manually processing payments for employees who did not use it caused delays. The adjudicator found that MyTime changed work practices, not employment terms. He also found no causal link between delayed payments and union membership, saying the delays arose from Tuohy’s refusal to use the app. Tuohy received €855.04 on 11 February 2022, but the adjudicator found the payment delay was not an unlawful deduction from wages. All three complaints failed.
