The Workplace Relations Commission found three complaints by Esb Networks Network Technician Michael Dolan not well founded in a decision dated 13 December 2022.
Dolan said the company’s move from paper timesheets to its MyTime app changed his employment terms, delayed overtime and allowance payments, and penalised him for refusing to use it. Esb Networks said MyTime changed work practices and that paper timesheets needed manual processing, delaying non-base payments for employees who did not use the app.
The WRC found the app changed work practices, not Dolan’s terms and conditions. It said payment delays arose from his refusal to use MyTime and were not linked to his Independent Workers’ Union membership.
On the Payment of Wages Act complaint, the officer said the claim covered only the six months before it was lodged and that delayed payment did not amount to an unlawful deduction. The decision records that Dolan received €2,672 on 25 March 2022.
