The Workplace Relations Commission found that Keith Kerley was not discriminated against by Arralis Limited in a decision dated 20 February 2023. Kerley said he received fewer share options than expected because of his nationality. He was offered 750 shares, while a colleague with Irish and British citizenship was offered 1,500. Arralis disputed discrimination and said the options were allocated at the shareholders’ discretion, based on factors including work and performance. The adjudication officer found Kerley had not established facts from which discrimination could be presumed. The complaint under the Employment Equality Act was found not well founded.
