The Workplace Relations Commission awarded John McKenna €4,648.80 in notice pay and €1,000 for a breach of employment-terms law in a decision dated 20 March 2024. The WRC found he was entitled to six weeks’ notice after 15 years’ service. The WRC found that Hamilton Park Care Centre Limited Hamilton Park Care Facility had not provided a complete written statement of employment terms. It calculated notice pay using weekly earnings of €774.73. Two equality complaints and an Industrial Relations Act complaint were not upheld. The WRC found that McKenna’s correspondence lacked enough detail to trigger an investigation under the workplace grievance process and that he had not processed his grievance at work. It also found his employment ended because of ill health and that the termination was fair. Two other complaints were withdrawn.
