The Workplace Relations Commission awarded Balazs Bihari €9,000 in compensation after finding that Brondsway Limited t/a Camden Court Hotel unfairly dismissed him by constructive dismissal. The decision was dated 20 March 2024.
Bihari, a restaurant manager who had worked at the hotel since 2008, said he was left without a return date as the hotel resumed operations after pandemic closures and had to find lower-paid work. The hotel said restrictions and reduced demand limited available work, and that Bihari did not return when asked.
The adjudicator found the hotel had provided no fair method for selecting staff to return and had never rostered Bihari or given him a restart date. Four other complaints, including three unfair dismissal complaints, were withdrawn. A duplicate unfair dismissal complaint was identified, with no further finding.
