The Workplace Relations Commission found that Paul Carroll was unfairly dismissed after 18 years as a senior software engineer at C. Rutter Custom Software Limited. It awarded him €1,269.23 for the dismissal, €2,115.38 in unpaid wages and €1,417.31 for accrued annual leave.

The decision, dated 2 March 2023, found that the cumulative effect of the employer’s conduct made it reasonable for Carroll to resign. He said delayed wages, incorrect payslips, unpaid taxes, pressure during a dispute between company directors and office CCTV had undermined his trust in the company.

Managing director Babar Shahzad said the wage delays were temporary, payslips had been corrected when raised and the company had a repayment plan with Revenue. The WRC accepted Carroll’s account that two weeks’ wages were owed and calculated his dismissal loss as six days between jobs.

Three other complaints were unsuccessful: the WRC found no race discrimination and ruled that the terms-of-employment and mobile transport complaints were not well founded. It found that the transport rules did not cover Carroll and that the wage delay and proposed change to payment frequency fell outside the terms-of-employment law.
