Bridget Clarke awarded €3,720 after WRC finds dismissal unfair

The Workplace Relations Commission found Bridget Clarke was unfairly dismissed and awarded her €3,720 in minimum notice pay. The decision was dated 5 August 2022.

Clarke challenged her dismissal for alleged gross misconduct after her employer said she had deliberately overpaid herself. She said the overpayment was a genuine calculation error, acknowledged it and offered to repay the money.

The adjudicator found the dismissal substantively fair but procedurally unfair because Clarke was not given an independent disciplinary hearing or appeal. The WRC also found her conduct contributed 100% to the dismissal, so compensation for unfair dismissal was nil. Her separate complaint under the Terms of Employment (Information) Act was withdrawn.
