The Workplace Relations Commission awarded Sean Nulty €1,020, equal to four weeks’ gross pay, after finding that the Board of Management of Loughegar National School had not given him a compliant written statement of his employment terms. The decision was dated 27 October 2022. Six other complaints were not well founded. The WRC rejected Nulty’s two wage complaints, accepting that the €11.09 hourly rate in a 2015 document was an error and that he received the applicable national minimum wage. It also found that he had been notified of his working hours in advance, and did not accept that a covered change to his terms had occurred. The core-terms requirement was not in force when his employment began in 2014. His constructive-dismissal complaint also failed; the adjudicator found his employer’s conduct did not justify his resignation and that he had not given the school an opportunity to address his grievances.
