The Workplace Relations Commission found Farzad Sedghi-khoi’s minimum-wage complaint against Barry Whelan Recruitment Ltd, trading as Excel Recruitment, was not well founded. The decision is dated 2 February 2022. Sedghi-khoi said he was underpaid and had worked more hours than the employer paid him for. The adjudicator found the complaint could cover only the six months before it was lodged in April 2021, when Sedghi-khoi was no longer employed by the company. An earlier complaint lodged in November 2019 had been withdrawn; a later complaint had been found outside the adjudicator’s jurisdiction because Sedghi-khoi had not requested a required pay statement.
