The Workplace Relations Commission ordered Ballymaley Stores Ltd Homesavers to pay former store manager Lorcan Mulvin €1,222.49 for outstanding wages and annual leave after finding the deduction unlawful. The decision was dated 5 January 2023. Mulvin said he was owed pay for 6.25 days worked and four days of annual leave after resigning. The company said it withheld the money pending an investigation into alleged theft and intended to deduct the value of goods from his wages. The adjudicator found the company’s valuation of the alleged losses was not sufficiently transparent and that Mulvin had not been given a chance to challenge it before the deduction. The WRC upheld his complaint under the Payment of Wages Act.
