The Workplace Relations Commission found Oliver Dixon’s unfair dismissal complaint against Francis Brophy & Company Chartered Accountants not well founded, accepting that the firm had acted fairly and reasonably in dismissing him for gross misconduct. The decision was dated 5 January 2023. Dixon had worked at the firm since 2004. It alleged he prepared accounts and assurance letters for private clients on its letterhead, failed to follow instructions and made false timesheet entries. Dixon disputed the allegations and said the firm’s principal had approved his private work. He also argued that the investigation and dismissal process was unfair. The WRC found that an independent investigation and appeal had taken place and that Dixon had the opportunity to respond. His appeal was not upheld. Under the Unfair Dismissals Act, an employer must have substantial grounds for dismissal and act reasonably; the WRC concluded the firm met that standard in this case.
