The Workplace Relations Commission found all five of Ivan Malovan’s complaints against McGrath Industrial Waste not well founded in a decision dated 13 December 2021. They concerned alleged wage deductions, unpaid annual leave, minimum notice, unfair dismissal and penalisation for raising safety concerns. Malovan said he was dismissed after raising concerns about a faulty bin-lift sensor. The company said he resigned after walking off the job. The WRC found he had resigned because breakdowns extended his working day, and found no evidence of an unsafe work system or penalisation for a safety complaint. Company records showed he was paid for his final week and holidays; the WRC also found the minimum-notice complaint failed because dismissal had not been established.
