The Workplace Relations Commission allowed Miroslav Lesko’s appeal against the refusal of statutory redundancy pay and found his minimum-notice complaint well founded. The decision was dated 10 December 2021. Lesko told the hearing he had worked as a chef for Crozen Restaurant T/A Crozen Inn from April 2015 to January 2020, earning average gross pay of €300 a week. He said he received no notice pay after bar staff told him the restaurant was closing in January 2020. The respondent did not attend, and the adjudication officer proceeded on Lesko’s uncontested evidence after finding reasonable efforts had been made to notify the respondent. The WRC said Lesko was to receive €600 gross in lieu of two weeks’ notice. His redundancy entitlement was subject to him having been in employment under the Social Welfare Acts during the requisite period. A second redundancy complaint was listed, but the decision gives no separate ruling on it.
