The Workplace Relations Commission awarded hotel general manager Peter Brennan €27,760 gross after finding his dismissal unfair. The decision was dated 10 December 2021.
Brennan said he was made redundant without consultation, a chance to appeal or an opportunity to discuss alternatives. B.c. McGettigan Limited, The Address Connolly (Formerly North Star Hotel) said pandemic restrictions had sharply reduced business and made his role redundant.
The WRC found the employer had not acted reasonably in handling the redundancy. It ordered compensation based on four weeks’ pay plus one year of lost earnings.
Brennan’s separate payment of wages complaint was not well founded. The WRC found the statutory redundancy and holiday pay calculations complied with legislation, and that it had no jurisdiction over the pension contribution issue.
