WRC declines jurisdiction over 11 complaints against Melcorpo Group

The Workplace Relations Commission declined jurisdiction over 11 complaints by Elizabeth Egan against Melcorpo Group, including unfair dismissal and transfer-of-undertakings claims. The decision was dated 6 March 2023; the merits were not decided. Egan said her work and terms changed after the cinema was acquired and alleged breaches of transfer-of-undertakings rules. The WRC found Melcorpo Group was not a legal entity and refused to replace it with Melcorpo Commercial Properties Unlimited Company, which it identified as Egan’s employer. It found the time limit for complaints against that company had expired before the request to amend the respondent’s name.
