WRC declines jurisdiction over 11 complaints by Elizabeth Egan

The Workplace Relations Commission declined jurisdiction over 11 complaints by Elizabeth Egan against Vevay Management Limited The Arc Cinema, including two unfair dismissal claims and nine complaints under transfer-of-undertakings rules. The decision was dated 6 March 2023; the merits were not decided. The WRC found Egan was not employed by the named respondent when she resigned. Revenue documentation identified Melcorpo Commercial Properties Unlimited Company as her employer. The WRC also found the transfer complaints were referred outside the time limit and that the correct employer could not be substituted after the statutory time frame had expired.
