The Workplace Relations Commission awarded Caroline Delaney €20,000 after finding St Patrick's Centre (Kilkenny) Limited failed to provide reasonable accommodation for her disability. In a decision dated 14 February 2022, it also found her dismissal was discriminatory and awarded €5,000.
Delaney worked as a social care worker and was fit for day duties at Deansgate, but medical evidence found she could not perform the full range of duties in community houses. The WRC concluded that allowing her to remain on day work at Deansgate would not place a disproportionate burden on the organisation. The centre said its move to smaller community units required staff to work flexibly across locations and duties.
The WRC also upheld Delaney's complaint that she had not received written employment terms and awarded her €100. The centre accepted it had no signed statement on file, while arguing she knew her conditions and had suffered no loss. Her age discrimination and conditions-of-employment complaints were not well founded.
