The Workplace Relations Commission found Courtney Geoghegan was not discriminated against because of pregnancy in a complaint about selection for re-employment. The decision was dated 11 February 2022. Geoghegan said she was selected because she was pregnant and that an August 2020 advertisement was substantially the same as her former role. Kidspace Rathcoole said reduced capacity required it to let go five temporary-contract staff with shorter service. The adjudicator found that the selection was based on service and that those retained had significantly longer service. The advertised Cook and Café Assistant role was distinct from Geoghegan’s Play Centre/Catering Assistant role. Her unfair dismissal claim had been withdrawn at the hearing.
