The Workplace Relations Commission ordered C&D Foods Ltd. to pay Dainis Jirgens €542.97 after finding his complaint over unpaid statutory notice pay well founded. The decision was dated 16 January 2024. Jirgens said the company dismissed him for failing to complete training he struggled to understand and that it had denied him a chance to reach the service required for statutory redundancy. C&D Foods said he received employment documents and could ask colleagues or managers for help during routine training. The WRC rejected his two complaints about employment terms and his discrimination complaint. It found the notice pay was due because a separate proceeding had found his dismissal unfair, so the company could not rely on the misconduct exception to avoid paying notice.
