WRC awards Maps Data Analyst €4,500 for unfair dismissal

By Donal Gilhooly

Workplace Relations Commission ·

The Workplace Relations Commission found a Maps Data Analyst was unfairly dismissed by a tech company and awarded him €4,500. It also directed the company to pay €500 for failing to provide written terms of employment. The decision was dated 4 May 2017. The adjudicator found that the analyst was an employee despite being engaged on a contractor agreement. Although a genuine redundancy arose after the client withdrew its Croatian market, the company did not adequately consider the other markets he worked on or consult him about alternatives or an appeal. The annual-leave and public-holiday dispute could not succeed under the Industrial Relations Act.
