In 1999, the Labour Court recommended that Ruibear Motair Teo pay a worker the Dungloe redundancy package when her employment ended. The recommendation followed the Services Industrial Professional Technical Union’s appeal of a Rights Commissioner’s decision that her claim fail. The worker transferred from Dungloe to Bunbeg, took maternity leave and later had her voluntary redundancy application refused. The union argued that she had been treated less favourably because redundancy terms were agreed for former Dungloe employees while she was on leave. The company said the package covered workers who could not transfer or had decided to leave. The Court based its recommendation on the Dungloe plant closure, her maternity leave and the unsuitability of alternative work she undertook briefly on a trial basis.
