The Labour Court rejected the Services Industrial Professional Technical Union’s appeal and upheld a Rights Commissioner’s recommendation concerning Mr Daly’s voluntary severance application. The decision was dated 25 June 1997. The recommendation provided for full severance entitlements and £2,000 compensation if Adm Ringaskiddy facilitated Mr Daly’s departure by 30 June 1997, or £5,000 if it could not. The union said he had been led to expect approval and treated unfairly; the company said it could not fill his role internally and compensation was not justified. The Court said Mr Daly should be allowed to take an early retirement package if it benefited him. If it did not, the Rights Commissioner’s recommendation was not unreasonable and should stand.
