In 1996, the Labour Court amended a recommendation in a dispute over a warehouse operator’s lost overtime earnings at Yves Rocher (Ireland) Limited. The decision was dated 10 September 1996. It said management should calculate any loss and compensate the worker on the basis of one year’s loss. Services Industrial Professional Technical Union said the worker regularly covered overtime and that the shift-flexibility agreement did not apply to him. The company argued that one exceptionally busy year was not a sound basis for compensation and cited the shift premium. The Court excluded the last quarter of 1993 and the first three quarters of 1994 from its assessment of loss.
