In 1996, the Labour Court upheld a recommendation for compensation for five workers in the Extracts Department at Yves Rocher (Ireland) Limited. The decision was dated 10 September 1996. The recommendation called for the shift-flexibility agreement’s formula to be used to calculate compensation for 1992, 1993 and 1994. Services Industrial Professional Technical Union said the introduction of shiftwork reduced the workers’ overtime earnings and that the agreement did not cover their department. The company said overtime had already fallen in 1991 and was variable, not guaranteed. The Court found the Rights Commissioner’s recommendation was not unreasonable and rejected the union’s appeal.
