In 1994, the Labour Court reduced an unnamed worker’s suspension without pay by the Western Health Board from 12 days to six, amending the Rights Commissioner’s recommendation. The decision was dated 16 March 1994. The Services Industrial Professional Technical Union appealed on the worker’s behalf. It argued the investigation should have focused on his unauthorised absence on 25 May 1993 and that earlier disciplinary incidents were introduced later. The Board cited his disciplinary record and disputed his account of when he learned of a medical appointment and whether he told colleagues he was leaving.
