In 1993, the Labour Court rejected the Amalgamated Engineering And Electrical Union's appeal and upheld a recommendation supporting Thermo King Europe's decision not to re-employ a worker after illness. The decision was dated 20 April 1993. The union argued that other doctors had found the worker fit to return and that he should be reinstated and compensated for lost earnings. Thermo King Europe said medical evidence and health and safety concerns supported its decision. The Court found no sufficient reason to alter the Rights Commissioner's recommendation and upheld it.
